For the past five years, the EPA has undertaken a highly-consequential national study on the impacts that hydraulic fracturing (fracking) can have on American drinking water supplies.

The agency will look to the results of this program as the basis for its scientific conclusions and recommendations on hydraulic fracturing,” EPA said in a 2013 statement.

This June, the national study's draft assessment was released to the public, and while hundreds of spills, accidents, and even cases where fracking itself directly contaminated underground aquifers (a method of pollution that the oil industry had long argued had never happened) were reported by EPA, it was a phrase from the agency's press release that drew the attention of the national media: “hydraulic fracturing activities in the U.S. are carried out in a way that have not led to widespread, systemic impacts on drinking water resources.”

But for fracking’s backers, a sense of victory may prove to be fleeting.

EPA’s draft assessment made one thing clear: fracking has repeatedly contaminated drinking water supplies (a fact that the industry has long aggressively denied).

Environmentalists Are Taking California To Court Over Illegal Oil Industry Wastewater Injection

Environmentalists filed a motion requesting a preliminary injunction today in a California court to immediately stop the daily illegal injection of millions of gallons of oil field wastewater into protected groundwater aquifers in the state.

Last week, Earthjustice filed a lawsuit on behalf of the Sierra Club and the Center for Biological Diversity in Alameda County Superior Court that challenges California regulators’ emergency rules meant to rein in the state’s disastrous Underground Injection Control (UIC) program.

More California Oil Industry Wastewater Injection Wells Shut Down Over Fears Of Groundwater Contamination

The latest in the ongoing investigation into California regulators’ failure to protect residents from toxic oil industry waste streams has led to the closure of 12 more underground injection wells. The 12 wells that were shut down this week are all in the Central Valley region, ground zero for oil production in the state.

California has roughly 50,000 underground injection wells. State officials are investigating just over 2,500 of them to determine whether or not they are injecting toxic chemical-laden oil industry wastewater into aquifers containing usable water (or at least potentially usable water) that should have been protected under the Safe Drinking Water Act.

A coalition of environmental, health and public advocacy groups filed a legal petition with Governor Jerry Brown last week in an attempt to force an emergency moratorium on fracking after it was discovered that flowback, a fluid that rises to the top of a fracked well, contains alarmingly high levels of toxic and carcinogenic chemicals.

Fracking flowback is an increasingly prevalent component of the oil industry wastewater that is being injected into the state’s aquifers, as fracking is now used in up to half of all new wells drilled in California.

Prompted by an inquiry by the federal Environmental Protection Agency in 2011, state officials shut down 11 wastewater injection wells last year over similar concerns that they were polluting badly needed sources of water in a time of prolonged drought. It was later confirmed that 9 of those wells were in fact pumping wastewater into protected aquifers—some 3 billion gallons of wastewater, by one estimate.

Since then, the fallout has continued at a rapid pace, with a new revelation coming seemingly every other month. In just the past few months, for instance, the scope of the problem has ballooned from hundreds of injection wells allowed to dump oil industry wastewater into protected aquifers to thousands more wells permitted to inject fluids from “enhanced oil recovery” techniques such as acidization and cyclic steam injection into protected aquifers.

Internal Documents Reveal Extensive Industry Influence Over EPA's National Fracking Study

In 2010, the Environmental Protection Agency (EPA) launched an ambitious and highly consequential study of the risks that hydraulic fracturing, or fracking, poses to American drinking water supplies.

This is about using the best possible science to do what the American people expect the EPA to do – ensure that the health of their communities and families are protected,” Paul Anastas, Assistant Administrator for the agency's Office of Research and Development, said in 2011.

But the EPA's study has been largely shaped and re-shaped by the very industry it is supposed to investigate, as energy company officials were allowed to edit planning documents, insisted on vetting agency contractors, and demanded to review federal scientist's field notes, photographs and laboratory results prior to publication, according to a review by DeSmog of over 3,000 pages of previously undisclosed emails, confidential draft study plans and other internal documents obtained through open records requests.

Company officials imposed demands so infeasible that the EPA ultimately dropped a key goal of the research, their plans to measure pollution levels before and after fracking at two new well sites, the documents show.

All told, the documents raise serious questions about the study's credibility and they highlight a certain coziness between the EPA and Chesapeake Energy, one of the most aggressive oil and gas companies in the shale gas rush.

“[Y]ou guys are part of the team here,” one EPA representative wrote to Chesapeake Energy as they together edited study planning documents in October 2013, “please write things in as you see fit”.

Chesapeake took them up on the offer.

Charges Filed Against President Of Freedom Industries, Company That Contaminated Drinking Water Of 300,000 West Virginians

The FBI has filed criminal fraud charges against Gary Southern, former president of Freedom Industries, the company responsible for contaminating the drinking water of 300,000 West Virginians with 10,000 gallons of a toxic coal-cleaning chemical called Crude MCHM that leaked into the Elk River.

The charges stem from Southern’s actions in the aftermath of the chemical spill, when the embattled company executive, who drew fierce criticism for drinking from a water bottle during a press conference in which he was attempting to apologize to West Virginians for contaminating their water supply, allegedly lied about his involvement with Freedom Industries in an attempt to shield himself from lawsuits and thus protect his personal fortune.

In a sworn affidavit included in the criminal complaint, FBI Special Agent James Lafferty says “Southern engaged in a pattern of deceitful behavior” centered around his role at Freedom before it was purchased in December 2013 by a company called Chemstream and his knowledge of conditions at Freedom’s Etowah Facility, the chemical storage site responsible for the chemical leak.

The threats posed by coal ash are well known today, but not too long ago, the dangers of coal ash disposal were a dirty energy secret.

For a large section of residents in Pennsylvania and West Virginia, the dangers of coal ash were kept a secret, and in their place the dirty energy industry fed them promises of a luscious, green and blue landscape that they could enjoy with their families. All they had to do was sign off on a coal ash dump in their area.

The energy company was First Energy, and a new short film by EarthJustice exposes the lies and the resulting impacts that their coal ash dump had on local communities.

Confirmed: California Aquifers Contaminated With Billions Of Gallons of Fracking Wastewater

Update 02/11/15: The problems with California's underground injection control program are far worse than originally reported. It has now been revealed that California regulators with DOGGR permitted hundreds of wastewater injection wells and thousands more wells injecting fluids for “enhanced oil recovery” into aquifers protected under the federal Safe Drinking Water Act.

Original post: After California state regulators shut down 11 fracking wastewater injection wells last July over concerns that the wastewater might have contaminated aquifers used for drinking water and farm irrigation, the EPA ordered a report within 60 days.

It was revealed yesterday that the California State Water Resources Board has sent a letter to the EPA confirming that at least nine of those sites were in fact dumping wastewater contaminated with fracking fluids and other pollutants into aquifers protected by state law and the federal Safe Drinking Water Act.

The letter, a copy of which was obtained by the Center for Biological Diversity, reveals that nearly 3 billion gallons of wastewater were illegally injected into central California aquifers and that half of the water samples collected at the 8 water supply wells tested near the injection sites have high levels of dangerous chemicals such as arsenic, a known carcinogen that can also weaken the human immune system, and thallium, a toxin used in rat poison.

Timothy Krantz, a professor of environmental studies at the University of Redlands, says these chemicals could pose a serious risk to public health: “The fact that high concentrations are showing up in multiple water wells close to wastewater injection sites raises major concerns about the health and safety of nearby residents.”

A new website launched today by the corporate accountability group asks ordinary Canadians to take a closer look at oilsands major Suncor's latest ad campaign, What Yes Can Do.”

By launching their own version of the ad campaign at, is questioning the disparity between “what yes can do” as Suncor puts it, and “what yes has done” in the Alberta oilsands. points out Suncor's green ad campaign, which emphasizes the corporation's efforts to preserve “…an environment for generations to come,” doesn't square with the company's own lobbying effort to limit protections for the Athabasca River. 

More than five years ago, a panel of experts recommended an end to water withdrawals from the Athabasca River during certain times of the year, when water levels are at their lowest. The cut-off would protect fish hatchlings and other aquatic life from dying off during low river flow.

All companies operating in the Alberta oilsands agreed to the recommended cut-off, but Suncor, along with Syncrude, are lobbying the Alberta government for an exemption
