Enbridge and Kinder Morgan Lobby Hard As Feds Change Tune on Pipelines

It’s been a month of mostly good news for Enbridge and Kinder Morgan, the two companies pushing to build major pipeline projects from Alberta’s oilsands to British Columbia’s coast.

Quick recap: on April 11, the National Post reported that the federal government is drawing up a pipeline implementation strategy for Kinder Morgan’s Trans Mountain Expansion Project and TransCanada’s Energy East pipeline.

Two weeks later, Bloomberg noted the federal government is reevaluating its tanker ban on the province’s northern coast, which currently bars exports from the Enbridge’s proposed Northern Gateway pipeline. On the same day (April 25), Enbridge’s Line 3 replacement project was quietly approved by the National Energy Board, boosting future exports by 370,000 barrels/day.

Capping off the busy spell is the May 6 announcement that Enbridge has requested a three year extension from the National Energy Board for the Northern Gateway pipeline. The company is required to begin construction by 2016 according to its current permits but says it needs more time to lock down legal permissions and further consult with Indigenous peoples.

The reinvigoration of these pipeline projects come on the heels of a major lobbying effort by both Enbridge and Kinder Morgan.

B.C.'s Failure to Consult First Nations Sets Enbridge Northern Gateway Pipeline Back to Square One

The provincial government did not fulfill its legal obligation to consult with First Nations on the Enbridge Northern Gateway pipeline, the B.C. Supreme Court ruled Wednesday.

The case, brought forward by the Gitga’at and other coastal First Nations, argued the province erred when it handed over decision-making authority for the project to the federal government under a provincial-federal Joint Review Process managed by the federal National Energy Board.

B.C. granted Ottawa authority over the project’s environmental review in a 2010 equivalency agreement. That agreement, however, did not release the province from the legal duty to consult First Nations, the B.C. Supreme Court found.

It’s a very significant ruling,” Elin Sigurdson, lawyer with JFK Law, said. “The coastal First Nations and Gita’at were very successful in the application to quash the equivalency agreement which means the province now has to consult with First Nations that will be affected by matters in the provincial jurisdiction and has to conduct a new environmental assessment for the project.”

Is the Enbridge Northern Gateway Pipeline Finally Dead?

In August 2014, Liberal leader Justin Trudeau made the trek to the tiny Gitga’at community of Hartley Bay, located along Enbridge’s proposed oil tanker route in northwestern B.C.

There, in the village of 200 people accessible only by air and water, he met with community elders and Art Sterritt, executive director of the Coastal First Nations.

He came to Gitga’at because he wanted to make sure he was making the right decision in terms of Northern Gateway and being there certainly confirmed that,” Sterritt told DeSmog Canada on Tuesday.

My confidence level went up immensely when Justin … visited Gitga’at.”

Two months before that visit, in May 2014, Trudeau told reporters in Ottawa that if he became prime minister “the Northern Gateway Pipeline will not happen.”

With Monday’s majority win by Trudeau, Sterritt — who retired three weeks ago from his role with Coastal First Nations — says he is “elated” and “Northern Gateway is now dead.”

Suzuki: Harper Didn’t Have the “Courage” to Present and Defend Northern Gateway Approval

David Suzuki isn’t surprised the federal government approved the contentious Northern Gateway pipeline Tuesday, but he is surprised Prime Minister Stephen Harper didn’t have the “courage” to announce the decision to Canadians.

Suzuki described the approval as “totally expected,” yet expressed dismay at the Prime Minister’s absence.

Harper indicated before the joint review panel even started its sessions he wanted that pipeline through,” Suzuki told DeSmog Canada. “What surprises me is he didn’t even have the courage to present his approval and defend it.”

This is such a craven thing, for the Prime Minister of the country to push through that agenda and then not even defend it, not even having any ministers out there defending it. I find that astounding.”

Northern Gateway is opposed by a majority of British Columbians, including most of the province’s First Nations.

Critics are saying the Harper government is insulating itself from political backlash associated with the pipeline's approval. Natural Resources Minister Greg Rickford even claimed it inaccurate to suggest the federal government approved the pipeline.

Northern Gateway Approved, But Far From Built

The Government of Canada approved the Enbridge Northern Gateway pipeline Tuesday, six months after the Joint Review Panel recommended the pipeline be built subject to 209 conditions.

Natural Resources Minister Greg Rickford said in a statement: “In December 2013, the Joint Review Panel found that construction and operation of the Northern Gateway Pipelines project is in the public interest, subject to 209 conditions being met by the proponent. After carefully reviewing the report, the Government accepts the independent Panel’s recommendation to impose 209 conditions on Northern Gateway Pipelines’ proposal.”

Today constitutes another step in the process,” Rickford said, adding Enbridge committed to working with “aboriginal groups and local communities along the route.”

Cleaning Up Canada’s Polluted Public Square

The most urgent environmental threat to Canadians isn’t climate change, the declining health of our oceans, or the extinction of species. It’s the pollution filling our nation’s public square.

In Edmonton this week, experts and lawyers have gathered again at the Joint Review Panel hearings on Enbridge’s Northern Gateway Pipeline and tanker project. They’ll challenge and defend percentages, growth, probabilities. They’ll speak about projections and expectations. They’ll talk about cost versus benefit.

Meanwhile, on the West Coast, a fragile ecosystem is very much alive. Its emerald green islands slope into the Pacific Ocean. Eagles soar over Douglas Channel, feeding off migrating salmon. The rare spirit bear forages on a beach for clams and cockles, unaware that its future is being debated in an Alberta hearing room.

Anyone paying attention to the panel’s hearings that resumed two weeks ago in Edmonton has probably noticed a lot of numbers being thrown around. The current hearings focus on the pipeline’s economics, which don’t always add up — price differentials, job numbers, refinery capacity, liabilities. But while Enbridge and other economic experts haggle over numbers, it seems obvious that some things can’t be assigned a dollar value. Some things are priceless.

The Great Bear Rainforest is an international treasure, home to magnificent cedar trees and the spirit (kermode) bear. Its waters are teeming with life — humpback, orca and fin whales all feed there.

Enbridge Video Stunningly Misleading

For compulsive watchers of Enbridge Inc., the spill-crazy pipeline company that wants to pipe tar sands crude to the Canadian West Coast - or just for students of the barefaced lie - this video can't be beaten.

It purports to show the pipeline route, including an open sea exodus where tankers will pass from the proposed Kitimat, British Columbia oil port.

But as this video documents, the Enbridge auteurs airbrushed out 1,000 square kilometres of islands and rocks within the exit channel.

Given the criticism, the company has added a note saying, “The animation is for illustrative purposes only. It is meant to be broadly representational, not to scale.”

Federal Investigation: "Complete Breakdown of Safety at Enbridge" Caused Kalamazoo River Tar Sands Oil Spill

It was the most expensive pipeline oil spill in the country’s history, the fallout from which still plagues the local communities, and government investigators have found that it was entirely preventable.

The National Transportation Safety Board released its findings from a two year investigation of the 2010 Enbridge tar sands crude pipeline spill (which DeSmogBlog has covered in depth) that dumped over a million gallons of toxic diluted bitumen (or DilBit) into the Kalamazoo River and its watershed.

The report draws two very stark, clear conclusions about Enbridge’s culture of safety, or lack thereof.

First, Enbridge had known of corrosion and cracking along the 6B pipeline for five years, but the company refused to make repairs.

“Enbridge detected the very defect that led to this failure (in 2005),” said NTSB Chairman Deborah A.P. Hersman, “…Yet for five years they did nothing to address the corrosion or cracking at the site, and the problem festered.” (You can watch video of the NTSB announcements here.)

Second, after the rupture, Enbridge employees had many opportunities to minimize the volume and impact of the spill, but failed repeatedly.
