Exclusive: Leaked EPA Draft Fracking Wastewater Guidance Suggests Closer Scrutiny for Treatment Plants

One of the most intractable problems related to fracking is that each well drilled creates millions of gallons of radioactive and toxic wastewater.

For the past several years, the Environmental Protection Agency has faced enormous public pressure to ensure this dangerous waste stops ending up dumped in rivers or causing contamination in other ways.

But the drilling boom has proceeded at such an accelerated pace in the United States that regulators have struggled to keep up, to control or even track where the oil and gas industry is disposing of this radioactive waste. As a consequence, hundreds of millions of gallons of partially treated waste have ended up in the rivers from which millions of Americans get their drinking water. 

An internal draft EPA document leaked to DeSmog gives a small window into how, after a full decade since the start of the drilling boom, the agency is responding.

The document, dated March 7, 2014, is titled “National Pollutant Discharge Elimination System Permitting and Pretreatment for Shale Gas Extraction Wastewaters: Frequently Asked Questions.”

It's revealing for what it shows about how EPA staff are taking the hazards of fracking wastewater more seriously — and also how little things have changed.

“In general, the EPA memo does a good job of making clear that fracking wastewater discharges are covered under the Clean Water Act, and that proper discharge permitting is required, including setting limits to protect water quality standards and to comply with technology based standards in the Clean Water Act,” explained Clean Water Action attorney Myron Arnowitt, who was asked by DeSmog to review the document. “It is mostly an increased level of detail for regional EPA staff regarding permitting issues under the Clean Water Act, compared to the pervious memo in 2011.”

The document, intended as a guide for local regulators on how the Clean Water Act should be interpreted and applied, is impressive in many ways.

Fracking California's Coast: Billions of Gallons of Fracking Pollution Legalized By Feds

If an energy company accidentally spilled 9 billion gallons of toxic waste into the ocean, the media, the public, and the government would be all over the situation.  But when it isn’t an accident, there is no reason for anyone to pay attention.

Such is the case with the fracking industry operating in California’s Santa Barbara Channel.  Federal regulators have given fracking companies the green light to dump as much as 9 billion gallons of waste into the waterway every single year.  This is in the same body of water that was devastated by millions of gallons of crude oil during a spill in 1969 that occurred as a result of a blowout on an oil rig operating in the area.  This environmental catastrophe led to the passage of the National Environmental Policy Act (NEPA).

Dos Cuadras Offshore Resources (DCOR) has been granted permits for four “mini” fracking exploration projects in the Santa Barbara Channel, all of which have been granted with certain environmental exclusions, as Truthout.org explains:

Across the U.S., the shale rush has unleashed a frenzy of excitement about domestic energy supplies.

But the oil and gas produced from fracking comes along with billions of gallons of wastewater and tons of mud and rock that carry radioactive materials and heavy metals.

Fracking Coming to Washington D.C.'s Drinking Water?

Over the past several years, the battle over fracking has brought Congressional hearings, protests and huge industry money to Washington DC. But in recent months the topic has taken on a new, more local turn in the nation's capital as oil and gas companies push to drill in a national forest near in the city's backyard and an unusual cast of charaters are lining up to oppose it.

The fight is over access to drill for shale gas in the George Washington National Forest and officials from the Environmental Protect Agency, Army Corps of Engineers and the National Park Service have come out in opposition, even though some of these same federal agencies have in other contexts helped to promote expanded shale gas drilling.

The forest is one of the East Coast’s most pristine ecosystems, home to some of its last old growth forests.

Horizontal drilling, key to shale gas extraction, has never before been permitted in the George Washington National Forest. But as the U.S. Department of Agriculture Forest Service prepares a new 15-year plan, drillers are pushing hard for the ban to be lifted despite the industry’s long record of spills, air pollution and water contamination on public lands.

Another Pennsylvania Wastewater Treatment Plant Accused of Illegally Disposing Radioactive Fracking Waste

A Pennsylvania industrial wastewater treatment plant has been illegally accepting oil and gas wastewater and polluting the Allegheny river with radioactive waste and other pollutants, according to an environmental group which announced today that it is suing the plant.
 
“Waste Treatment Corporation has been illegally discharging oil and gas wastewater since at least 2003, and continues to discharge such wastewater without authorization under the Clean Water Act and the Clean Streams Law,” the notice of intent to sue delivered by Clean Water Action reads.
 
Many pollutants associated with oil and gas drilling – including chlorides, bromides, strontium and magnesium – were discovered immediately downstream of the plant’s discharge pipe in Warren, PA, state regulators discovered in January of this year. Upstream of the plant, those same contaminants were found at levels 1 percent or less than those downstream, or were not present at all.
 
State officials also discovered that the sediments immediately downstream from the plant were tainted with high levels of radium-226, radium-228 and uranium. Those particular radioactive elements are known to be found at especially levels in wastewater from Marcellus shale gas drilling and fracking, and state regulators have warned that the radioactive materials would tend to accumulate in river sediment downstream from plants accepting Marcellus waste.
 
“To us, that says that they are discharging Marcellus Shale wastewater, although no one admits to sending it to them,” said Myron Arnowitt, Pennsylvania State Director for Clean Water Action.

Shale Industry Moves to Ship Fracking Waste via Barge, Threatening Drinking Water Supplies

It was meant to go unnoticed. A small announcement out of a commissioners’ meeting signaled plans to transport fracking wastewater by barge down the Ohio River. But it caught the eye of locals and offers a further reminder of why handling and disposal of the wastewater is truly one of the shale drilling industry’s most important and overlooked concerns.
 
Construction is already completed at one barging facility in the Marcellus region. A Texas-based company, GreenHunter Water, has built a shipping terminal and 70,000-barrel wastewater storage facility on the Ohio River in New Matamoras, Ohio. GreenHunter officials have said they are currently accepting about 3,000 barrels of fracking wastewater per day.

The U.S. Coast Guard is now reviewing plans to barge fracking wastewater in the region’s rivers, which serve as the drinking water supplies for over half a million people.  
 
These plans have raised alarm for many reasons. In the event of a barge accident, the drinking water for major cities like Pittsburgh could be immediately contaminated; the barges themselves could become radioactive because Marcellus shale wastewater carries unusually high levels of radium; spills or illegal dumping could be harder to detect in water than on land.

Experts Air Serious Concerns Before New York Fracking Decision

Two recent court decisions  in New York state upheld the right of towns to use zoning laws to limit or even ban fracking within their borders. Other states and cities such as DallasMaryland, and North Carolina, are still trying to figure out whether, and if so how, to proceed with new drilling.

But the big decision that concerned citizens are watching is the one to be made by New York Gov. Andrew Cuomo about his state’s moratorium. New York received more than 40,000 public comments on fracking and is plowing through them now.

The state has yet to publish those documents on the web, but DeSmogBlog has obtained many of them. Here is our initial shortlist of comments that offer the most important warnings and useful insights.

A Hidden Threat?

One of the most overlooked but potentially dangerous public health issues relating to unconventional gas drilling is radon. This odorless and radioactive gas comes up from the wells mixed with the gas that gets piped to consumers. Highly carcinogenic, radon is the second leading cause of lung cancer, just behind cigarette smoking, according to the EPA.

In his comments, Dr. Marvin Resnikoff, director of Radioactive Waste Management Associates, concludes that radon levels in the gas that will come from Marcellus and likely be delivered to nearly 12 million New York residents will be far higher than current levels. As a result, “the potential number of fatal lung cancer deaths due to radon in natural gas from the Marcellus shale range from 1,182 to 30,448” he writes.

Make Money Having Fun, A Company That Makes Money Contaminating Water Supplies

An Oklahoma coal fly ash disposal company has found themselves in hot, contaminated water over their practice of using oil and gas wastewater brine in the disposal of fly ash. According to the Oklahoma Corporation Commission, the fly ash disposal firm called (no joke) Make Money Having Fun, LLC has been ordered to indefinitely suspend their practice of mixing oil wastewater with fly ash until they can resolve their numerous contamination problems.

And after years of trying to clean up their state, Oklahoma residents have been granted at least a temporary victory by the E.P.A. in their efforts to prevent Make Money Having Fun, LLC from continuing to poison their water supply. From the Tulsa World News:

The EPA issued a cease-and-desist order against Making Money Having Fun in April 2010 for violations of the federal Clean Water Act stemming from the discharge of pollutants into a tributary of Doe Creek.

Fracking Wastes Devastate Research Forest in Virginia

Wastewater from hydraulic fracturing (fracking) operations poses a serious threat to national forests, according to a researcher from the U.S. Forest Service. Mary Beth Adams conducted a two year study of soil and vegetation health in West Virginia after more than 75,000 gallons of fracking wastewater were applied to a portion of forest set aside for research. 

The study, appearing in the July-August issue of the peer-reviewed Journal of Environmental Quality, tracks the effects of fracking wastewater on a quarter-acre section of the Fernow Experimental Forest in the Monongahela National Forest. Adams monitored the effects of the land application over a two-year period.

Within two days, the contaminated fluids had killed all ground level plant life and within 10 days began to brown the foliage of trees. Within two years all of the trees showed signs of damage and more than half of the 150 trees in the test area were dead. The study notes a dramatic 50-fold increase of sodium and chloride in surface soil after the application, but, because the chemical composition of fracking wastes is protected as proprietary information, the full contamination effects could not be studied.
